The present conditions govern the CD-sales on the Website These conditions shall prevail over all other terms of sale, in particular over those applicable to the sales of these products by any other distribution channels.


Article 1 – Prices

1.a – The prices of our products are given in Euros including all taxes (VAT and additional taxes) excluding order processing and shipping costs.

1.b – Eurochor reserves the right to change prices without notice at any time but the products will be charged on the basis of the prices in force at the moment of the order.

1.c – The products remain the property of Eurochor until effective payment of the total amount due.


Article 2 – Order

Contractual information is presented in English and will be confirmed with a summary of said information, at the latest upon delivery. Eurochor reserves the right to cancel or refuse any order from a customer with an existing dispute concerning the payment of a prior order.


Article 3 – Approval

You declare having read and accepted the present conditions before placing your order. Thus, order approval implies the acceptance of the these General terms and conditions.

In the absence of evidence to the contrary, the data recorded by Eurochor shall constitute proof of all transactions effected between Eurochor and its clients.


Article 4 – Availability

Our products offers and prices are valid as long as they remain visible on the website, limited to the available stock.

Should a product be unavailable after having placed your order, we will inform you by Email or letter. Your order will be cancelled automatically and you will be refunded if your bank account has been charged, either by crediting the your bank account or by bank check, at Eurochor’s discretion.


Article 5 – Shipping

Goods will be shipped to the shipping address specified by you in the ordering process. Shipping delays are from 4 to 15 working days depending on the ordered products. Said delays may be exceeded in case of force majeure. Eurochor shall not be held responsible for circumstances beyond its control (package loss by the carrier, theft, damages etc). Should you not receive your package within 15 working days from the shipping confirmation email, please contact Eurochor shipping service. We will then investigate the case and, should your order be certainly lost or damaged, we will reship the products.
Eurochor shall in no event be liable for possible damages sustained after the package has been given to the carrier. Eurochor cannot be held responsible for any consequences due to shipping delays. Any order not dispatched within 30 days of the order will be cancelled, unless stipulated otherwise and specified in the sales offer.

Article 6 – Payment

Upon receiving your order confirmation, your card will be debited.
Under current legislation, the customer shall have a delay of seven (7) days from the acceptance of the products to exercise his or her right to return the purchase without having to provide a valid reason nor pay any penalties, with the exception, if necessary, of the cost of return. This delay shall commence on the date on which the products have been received by the customer, or the date on which the service offer has been accepted.

6.a – CD Refund
Under current legislation, the customer shall have a delay of seven (7) days from the acceptance of the products to exercise his or her right to return the CDs without having to provide a valid reason nor pay any penalties, with the exception, if necessary, of the cost of return. This delay shall commence on the date on which the products have been received by the customer.
The refund of physical products resulting of a retraction shall only be realised in form of credit valid on your future orders. Every product to be exchanged or refunded shall be returned to Eurochor in its original package and plastic sealing (the blister packaging of the CDs should not have been opened).
Any Products that are returned incomplete, damaged or dirtied by the customer shall not be accepted nor refunded.

6.b – Damaged products – Conformity warranty
Eurochor offers a refund or exchange of files or damaged products. Should such a case arise, please give a detailed claims report to Eurochor sales as soon as possible. In any case, you shall be entitled to legal warranties as to conformity and to hidden defects, this in accordance with the French legal provisions in force.

Article 7 – Safety
Our website is the subject go a system of security. A specialised banking intermediary is in charge of payment processing. They have reinforced the whole of the jamming and encryption processes to protect all sensitive information related to the methods of payment as efficiently as possible. However, neither Eurochor nor its secure payment service provider shall be held by no means responsible for the violation of banking credit card data.

Article 8 – Intellectual Property
8.a – All texts, commentaries, works, illustrations and images reproduces on the website are protected by copyright as well as intellectual property worldwide. As such and in accordance with the provisions of the Code of Intellectual Property, only the private use is authorised which is subject to different, even more restrictive provisions of the code of intellectual property. Total or partial reproduction of the website is strictly prohibited.

8.b – The online music samples may not be downloaded, copied, duplicated or used for other purposes that listening to it on the website


Article 9 – Liability
The products offered are in compliance with the French legislation in force. The responsibility of Eurochor cannot be engaged in case of non – compliance with the legislation of the country where the products are delivered (e.g. in case of banning of a certain title). It is your responsibility to check with local authorities the possibilities of importation or use of the products you plan to order.

In case of manifest error between the characteristics of the product and its representation and/or conditions of sale, Eurochor cannot be held responsible.


Article 10 – Applicable law – Disputes

This contract is subject to the French law.
The language of this contract is the French language.
In case of dispute, French courts shall have sole jurisdiction.
